Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website "https://www.climbingsenpai.com" (the "Website") and the services provided by GRIPSOL ENTERPRISES (OPC) PRIVATE LIMITED (the "Company", "we", "our"). By using the Website and making a booking, you agree to comply with and be bound by these Terms. Please read these Terms carefully before accessing or using the Website.

 

2. Slot Booking Process

2.1. The Company provides slot booking for coaching sessions at the Bangalore Boulder gym located in Malleshwaram, Bengaluru or any other site, designated by the Coach, to be a coaching location. Each coaching session is fixed for a duration of one hour, available at 7:00 AM to 8:00 AM or 8:30 AM to 9:30 AM on Mondays, Wednesdays, and Fridays. Bookings are accepted based on availability, and customers may book only one slot per session.  

2.2. Available slots are limited and may not be available if the full capacity has been reached. Customers will receive an email confirmation of their booking.

 

3. Pricing and Payment

3.1. The price for each coaching session is INR 1,250 per hour. Payment can be made via Razorpay, using options such as credit/debit cards, UPI, and net banking.  

3.2. All payments for booked sessions are final. The Company does not charge any additional fees, such as booking fees, convenience fees, or registration fees.

 

4. Cancellation and Rescheduling Policy

4.1. To cancel or reschedule a session without incurring additional charges, please inform us at least 24 hours before the scheduled session via email at betahubindia@gmail.com. Cancellations or rescheduling within 24 hours will incur a charge of INR 375.  

4.2. No refunds will be provided for a no-show by the participant. In the event of a missed class from the coach's end, a full refund will be provided.  

4.3. For emergencies, customers are encouraged to contact us via email, and refunds will be provided on a case-by-case basis.

 

5. Liabilities and Limitations

5.1. The Company is not liable for any loss, damage, or inconvenience caused by issues beyond its control, including but not limited to unavailability of slots, internet disruptions, or unforeseen technical issues.

 

6. Intellectual Property

6.1. All content on the Website and  social media accounts of Lokesh Rajan Chandra (https://www.instagram.com/betahubindia?igsh=OHI4MDVqeG1hbmI1) and https://www.instagram.com/climbingsenpai?igsh=YWk0NzR3MmtqdWYz) including but not limited to text, images, logos, and other materials, is the intellectual property of GRIPSOL ENTERPRISES (OPC) PRIVATE LIMITED. Users may not reproduce, distribute, or otherwise use any content from the Website without the Company's prior written consent.

 

7. User Conduct

7.1. Users agree not to misuse the Website or engage in fraudulent activity or disruptive behavior during coaching sessions. Any misuse may result in the cancellation of bookings and other appropriate actions.

 

8. Dispute Resolution

8.1. Any disputes or complaints should be directed to customer support via email at betahubindia@gmail.com. If unresolved, the issue will be escalated to a senior team member for review.

 

9. Governing Law and Jurisdiction

9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

Refund and Cancellation Policy

 

1. Cancellation Policy

3. Emergency Refunds

3.1. In case of an emergency, refunds may be considered on a case-by-case basis. Customers are advised to reach out via email to request a review.

Conditions of Use

Risks - Climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.

 

Although the Climbing Centre is an artificial environment, the risks involved are no less serious than when climbing outside on a boulder, crag or mountain. There is an additional risk that bolt-on holds can spin or break.

 

The soft flooring under the bouldering walls is designed to provide a more comfortable landing for climbers falling or jumping from the bouldering wall. THE SOFT FLOORING DOES NOT MAKE THE CLIMBING ANY SAFER. Broken and sprained limbs are common on this type of climbing wall despite the soft landing. Uncontrolled falls are likely to result in injuries to yourself or others.

 

Climbing beyond your capabilities on any wall is likely to result in a fall. Any fall may result in an injury despite the safety systems in place to avoid it. You must make your own assessment of the risks whenever you climb.

 

Our Duty of Care - The Rules of the Climbing Centre that are set out below are not intended to limit your enjoyment of the facilities. They are part of the duty of care that we, as operators, owe to you, the customer, by law. As such they are not negotiable and if you are not prepared to abide by them then the staff must politely ask you to leave.

 

Your Duty of Care - You also have a duty of care to act responsibly towards the other users of the Centre. Statements of ‘Good Practice’ are posted around the Centre adjacent to the relevant facilities. These describe the accepted methods of use and how customers would normally be expected to behave towards each other.

 

Unsupervised Climbing - Before you climb without supervision, the Centre expects you to be able to describe the dangers involved with the relevant facilities and accept the risks involved.

 

You are required to register to say that you understand the Conditions of Use, that you are prepared to abide by the Rules below and that you understand the risks involved in your participation.

 

Whilst you climb without supervision, the Centre expects you to be aware of all other climbing users.

 

Anyone who cannot register as competent is classed as a novice and must not climb without supervision.

 

Unsupervised climbing is just that! If you are not confident in the use of any climbing equipment or technique then do not attempt to use it without the supervision of someone who is competent to do so.

 

Supervised Climbing - An adult who has registered at the Centre as competent and passed a supervisor assessment for the relevant facilities may supervise up to two novices/juniors.

 

Children (Under 18) – All children in the Centre must be supervised by an adult unless they have been assessed by the management and registered for unsupervised climbing. In addition to the obvious risks of climbing, children on the ground are at particular risk of being seriously injured by falling adult climbers. Supervising adults are responsible for making sure that children are never directly below climbers.

 

Gripsol Enterpises associated Climbing Centre(s) Safety Rules

 

  • Report to Reception on each visit before you climb.

  • You must exercise care, common sense and self-preservation at all times.

  • Report any problems with the walls, equipment or other climbers’ behaviour to a member of staff immediately.

  • Be aware of the other climbers around you and how your actions will affect them.

  • Do not distract people while they are climbing.

  • Stand well back from the climbing walls unless you are spotting a climber. Never stand directly under someone who is climbing.

  • Never climb directly above or below another climber.

  • Do not climb over or on top of any climbing walls and structures unless it explicitly states that you can.  Do not grab or touch any girders, metalwork or lights.

  • Always climb within your capabilities and descend by down climbing or, at the very least, a controlled fall/jump.

  • Keep the safety mat free from objects or obstructions such as bags, clothing, brushes, shoes etc.

  • No food or drink is permitted on the mats.

  • Do not climb under the influence of alcohol or drugs.  Smoking is not permitted in the Centre. 

  • Respect the Centre and all the equipment therein.  Damage to Centre property will not be tolerated.
